1. General
1.1 These terms of use (“Terms”) apply to your use of the ZAPATAG and govern the relationship between [ZAPA Technology Limited/JVCO] (“we”, “us”) and the ZAPATAG user (“you”, “your”). Use of your ZAPATAG will constitute acceptance of these Terms. Please take the time to read the Terms carefully. If you have any questions about the Terms or about your ZAPATAG, please contact your local Love Your Town Office (“LYT”), details of which can be found on www.loveyourtown.ie, or the Promoter by telephone on 01-2134700 between the hours of 9.00am and 5.00pm (Monday to Friday other than [bank/public holidays]).
1.2 We reserve the right at any time, and from time to time, to modify or amend these Terms. Notice of the changes will be made available in advance on the website, www.loveyourtown.ie. You understand and acknowledge that the most recent version of these Terms will be located on the website www.loveyourtown.ie. Your continued use of your ZAPATAG constitutes an acknowledgement by you of any modification to these Terms and consent to be bound by such modified Terms. You are expected to check these Terms as posted on our website from time to time to take notice of the changes made as they are binding on you. If you do not agree with these Terms, as amended from time to time, you should stop using your ZAPATAG.
1.3 The Promoter of the ZAPATAG is ZAPA Technology Limited, 3rd Floor, The Grange, Stillorgan Road, Blackrock, County Dublin. Company Reg. No. 466312.
2. Purchasing your ZAPATAG
2.1 A ZAPATAG can be purchased from the LYT store and St Jarlath’s Credit Union on the Dublin Road,Tuam, by paying a fee of €10. We reserve the right to waive or alter the amount of this purchase fee. You must be resident in the Republic of Ireland. A ZAPATAG can only be registered in the name of an individual.

3. Earning and Redeeming Benefits
3.1 You can use your ZAPATAG in participating outlets to avail of offerings provided by such outlets, which may include earning and redeeming points on certain purchases or to avail of offers/vouchers and other benefits that have been loaded to your ZAPATAG from time to time (collectively referred to as “Benefits”). A list of participating outlets, the Benefits available in such outlets and the conditions of use relating to such Benefits, can be found on our website www.loveyourtown.ie. Further information on the ZAPATAG can be found on www.zapatag.ie.
3.2 To earn, load or redeem Benefits on your ZAPATAG, your ZAPATAG must be tapped at the Zapa contactless reader in participating outlets.
3.3 Benefits cannot be accrued or earned for, nor redeemed in connection with, the purchase of lottery tickets, prescription medicine, infant formula products, mobile top-up cards/vouchers, call cards, gift vouchers, tobacco products, postage stamps or the plastic bag levy. Other products may be excluded from the ZAPATAG scheme at any time by prior notice on the website www.loveyourtown.ie at the sole discretion of ZAPA Technology Limited or by operation of law.
3.4 Benefits will be added to your ZAPATAG instantly, except in circumstances of system failure. Benefits cannot be redeemed until added to your ZAPATAG.
3.5 You cannot accrue or earn Benefits on products or services, which have been paid for with Benefits.
3.6 You can only redeem Benefits against purchases made in the participating outlet to which the relevant Benefit relates. You must have sufficient Benefits to pay in full for a purchase if you wish to redeem such Benefits. Benefits may not be used as part payment for a purchase.
3.7 Benefits collected do not have any monetary value and cannot be exchanged, sold or transferred. Benefits may not be transferred from one ZAPATAG to another nor pooled together in any manner.
3.8 You are responsible for the security of your ZAPATAG and for any transactions which involve the use of your ZAPATAG.

4. Registering your ZAPATAG
4.1 To help protect the Benefits collected by you and stored on your ZAPATAG from loss, theft or damage, please register your ZAPATAG by following the instructions on our website www.loveyourtown.ie to open a ZAPATAG scheme account (“Account”). If you need to change your details at any time, you can do so by amending your settings in the “MY ACCOUNT” section of our website. It is your responsibility to notify us of any changes to your details.

5. Breach of Terms of Use and Termination
5.1 Any Benefits accrued, earned or collected otherwise than in accordance with these Terms will be invalid and cannot be redeemed.
5.2 If we have reasonable grounds to suspect that you are engaged in fraudulent, illegal, or undesirable activities relating to us or your ZAPATAG, or if you supply false or misleading information to us or participating outlets, or breach these Terms, we reserve the right, on notice to you, to cancel all of your accrued or earned Benefits, and/or to suspend your right to accrue, earn and/or redeem Benefits.
5.3 We reserve the right to (i) stop issuing ZAPATAG at any time; and/or (ii) on notice, withdraw or cancel any issues ZAPATAG and/or the Benefits (including the issue and redemption of such) and/or (iii) terminate the ZAPATAG scheme.
5.4 You may cancel your ZAPATAG and/or your ZAPATAG scheme Account at any time. If you terminate your ZAPATAG and/or your ZAPATAG scheme Account you will lose the right to redeem all unused Benefits.
5.5 Your ZAPATAG is issued by and remains the property of ZAPA Technology Limited. You must return your ZAPATAG to us on request or destroy it if we so request.

6. Loss, Theft or Damage
6.1 If you have registered your ZAPATAG as referred to above, you should immediately notify our Customer Relations Department by telephone on 01-2134700 between the hours of 9.00am and 5.00pm (Monday to Friday)] of any loss or theft of, or damage to, your Zapa Tag.
6.2 If your ZAPATAG is lost, stolen or damaged, and you have registered your ZAPATAG as referred to above, you may purchase a replacement ZAPATAG and transfer any valid Benefits that have not been redeemed to the replacement ZAPATAG. If you subsequently find or retrieve ZAPATAG which you have reported lost or stolen, you must notify us immediately.

7. Liability of ZAPA Technology Limited
7.1 The Promoter shall not be held liable for any default or loss suffered by you resulting directly or indirectly from any cause beyond our control, including but not limited to, failure of network services and failure of data processing systems.
7.2 The Promoter is not responsible for Benefits, goods or services of or from third parties, including participating outlets or other suppliers. These are offered according to that third party’s terms and conditions.

8. Data Protection
8.1 These Terms and our Privacy Statement, govern our use of personal data collected from you. Full details of the Privacy Statement can be found at www.zapatag.ie.
8.2 On establishing your ZAPATAG scheme Account and giving us your personal details, you agree that your details will be used to send you information and updates about the ZAPATAG scheme.
8.3 We will also use the information you give to us and information on what you buy to help us manage the ZAPATAG scheme more effectively. We may share aggregated data with third parties in order to develop and enhance the ZAPATAG Scheme. This is statistical data which will not include information that could identify any individual.
8.4 We will share your information with our affiliates, our service providers and our partner companies to help us manage and administer the ZAPATAG scheme.
8.5 It is important that your contact details are kept up to date in order that we can operate the ZAPATAG scheme effectively. Please keep your details up to date via your “MY ACCOUNT” section of the website www.loveyourtown.ie.

9. General
9.1 These Terms are governed by Irish law. The courts of Republic of Ireland will have exclusive jurisdiction to settle any claim or matter arising under or in relation to these Terms.
9.2 If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
9.3 These Terms and any document expressly referred to in them represent the entire agreement between you and us in relation to their subject matter and supersede any prior agreement, understanding or arrangement between you and us, whether oral or in writing.
9.4 Each of you and us acknowledge that neither has relied on any representation, undertaking or promise given by the other and may not be implied from anything said or written in discussions between us except as expressly stated in these Terms.
9.5 If we fail to insist upon strict performance of any of your obligations under any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under these Terms, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of your obligations under these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
